FLOOR AMENDMENT EXPLANATION

 

  1. Establishes that sober living homes must be licensed once the Director of the Department of Health Services (DHS) establishes standards and requires sober living homes to apply for licensure within 90 days after initial licensure rules are final.

 

  1. Directs DHS to notify the sober living home certifying organization, Legislative Council and each municipality when licensure rules are final.

 

  1. Allows DHS to contract with a third party for sober living home licensure and inspections.

 

  1. Repeals statute that permits municipalities to limit or prohibit the use of rentals for sober living homes 90 days after the date that DHS finalizes sober living home licensure rules.

 

  1. Prohibits municipalities from disclosing the address of a sober living home except to law enforcement and emergency personnel.

 

  1. Permits DHS to disclose sober living home addresses to local jurisdictions for zoning purposes.

 

  1. Removes the requirement that treatment facilities additionally obtain accreditation from a national organization.

 

  1. Makes technical and conforming changes.

B.  The director of the department of health services shall notify in writing the director of the Arizona legislative council and each city, town and county in this state of the date the rules are finalized."
